The other day, the President of Ukraine, Petro Poroshenko, signed the Law of Ukraine No. 2229-VIII "On Prevention and Combating Domestic Violence." This is reported by the official online representation of the President of Ukraine.
The document envisages the implementation of a comprehensive approach to the fight against domestic violence, a significant addition to the existing tools for such a fight, the introduction of new definitions of terms, and other norms aimed at improving the protection of victims of domestic violence. In particular, the Law provides for the creation and operation of the Unified State Register of Cases of Domestic Violence.
The document is aimed at harmonizing the provisions of the current legislation of Ukraine in the field of combating domestic violence and violence against women and adapting it to European standards, which ensure the preparation of the basis for the ratification of the Istanbul Convention.
The final provisions of the law amend the Code of Ukraine on Administrative Offenses. They provide that the commission of domestic violence, gender-based violence, that is, the intentional commission of any actions (actions or inactions) of a physical, psychological or economic nature (the use of violence that did not cause bodily harm, threats, insults or harassment, deprivation of housing, food, clothing, other property or funds to which the victim has a legal right, etc.), as a result of which the physical or mental health of the victim may have been or has been harmed, as well as failure to comply with the urgent restraining order by the person against whom it was issued, or failure to notify the authorized units of the National Police of Ukraine of the place of temporary stay in the event of its issuance, entails the imposition of a fine of ten to twenty tax-free minimum incomes of citizens or community service for a period of thirty to forty hours, or administrative arrest for a period of up to seven days. The same actions committed by a person repeatedly during the year entail the imposition of a fine of twenty to forty tax-free minimum incomes of citizens or community service for a period of forty to sixty hours, or administrative arrest for a period of up to fifteen days.
