From April 1, 2016, the order of the Ministry of Education and Science of Ukraine No. 8 of January 12, 2016, registered in the Ministry of Justice of Ukraine on February 3, 2016 under No. 184/28314 "On the approval of the Regulation on individual forms of education in general educational institutions" comes into force.
The new Regulation expands the list of persons for whom an individual form of education can be introduced, namely:
- who live in the zone of armed conflict, in the temporarily occupied territory of Ukraine or in settlements, on the territory of which state authorities temporarily do not exercise or do not exercise their powers to the full extent, etc. and emergency situations of a natural or man-made nature (using the distance form of education) ;
– are foreigners or stateless persons (refugee children, children whose parents have submitted applications for recognition as refugees or persons in need of additional or temporary protection, children of foreigners and stateless persons detained in temporary residence centers for foreigners and stateless persons) .
The training of students who need to undergo medical treatment in a health care institution for more than one month is carried out directly in this medical institution. The local education management body determines the educational institution whose teaching staff will carry out the educational process based on its territorial location.
In addition, Clause 3 of Section III of the Regulation stipulates that an extract from the protocol of psychological-medical-pedagogical consultation is not mandatory for enrolling students in an individual form of education, except for students whose education requires the determination of special educational needs, teaching methods and other additional measures educational process.
At the same time, in accordance with Part 3 of Article 29 of the Law of Ukraine "On General Secondary Education", if parents or persons who replace them, contrary to the conclusion of the appropriate psychological-medical-pedagogical consultation, refuse to send the child to the appropriate special general education school (boarding school) , the child's education is carried out on an individual basis.
